These Terms of Service ("Terms") govern your use of Peranima ("Service"), provided by Eduard Röhrig, Iris-Runge-Platz 11, 30539 Hannover, Germany ("we", "us"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
Peranima is a native desktop application that provides a fully customizable AI voice companion ("Animus") for gaming. You create each companion's name, voice, and personality. During a session the app streams your microphone audio — and, on the companion's request, a screenshot of your active window — to third-party AI processing partners that produce the companion's voice responses in real time. We may change the underlying providers at our discretion to improve quality, latency, or cost.
Optional Integrations (e.g. the Minecraft companion that joins your LAN world) extend what the companion can do. Each Integration is opt-in per companion in your settings.
2. Eligibility and accounts
You must be at least 16 years old to use Peranima. If you are under 18 you confirm that a parent or legal guardian has consented to these Terms on your behalf. You must register using Discord OAuth and provide accurate information.
3. Acceptable use
You agree not to:
- use the Service to generate content that is illegal, defamatory, harassing, sexually explicit involving minors, or that incites violence;
- attempt to extract, reverse-engineer or misuse the underlying AI models;
- interfere with or disrupt the Service, our infrastructure or other users' sessions;
- share, resell or sublicense your account to third parties;
- use the Service for any purpose prohibited by the policies of our upstream service providers.
4. Subscription, pricing and renewal
Peranima offers a free trial tier (a one-time starter credit plus a small monthly usage allowance) and three paid tiers (Pro, Max, Ultra). Paid subscriptions are billed monthly by LemonSqueezy in US dollars. Your subscription renews automatically at the end of each billing period unless cancelled before renewal.
All prices include applicable VAT and sales taxes where required — the price you see is the price you pay. Any change to prices or included usage limits will be announced at least 14 days in advance by email.
5. Right of withdrawal (Widerrufsrecht)
You have the right to withdraw from the subscription contract within 14 days without giving any reason. To exercise this right you must inform us by clear statement (e.g. email to info@peranima.com) of your decision to withdraw. You may use the model withdrawal form at the end of these Terms, though it is not required.
By starting a paid voice session during the 14-day withdrawal period you expressly consent that we begin performance of the service immediately and you acknowledge that you will lose your right of withdrawal once the service has been fully performed (§ 356 Abs. 4 BGB).
6. Cancellation
You can cancel your subscription at any time from the billing page of your dashboard. Your access remains active until the end of the already-paid billing period; no pro-rated refunds are issued except as required by Section 5 above or by mandatory law.
7. Content and ownership
You retain ownership of the words you speak into the Service. By using Peranima you grant us a worldwide, royalty-free, non-exclusive licence to process that audio solely for the purpose of producing AI responses on your behalf. The AI-generated text and voice responses are yours to use as you see fit, subject to any third-party model licence terms.
8. Availability and disclaimer
We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. AI-generated content may be inaccurate, biased or inappropriate; do not rely on it for medical, legal, financial or safety-critical decisions.
9. Liability
Our liability is limited to damages caused by intent or gross negligence, except for (i) damages arising from injury to life, body or health, (ii) claims under the German Product Liability Act (Produkthaftungsgesetz), and (iii) damages resulting from the breach of essential contractual obligations ("Kardinalpflichten"), which are limited to foreseeable damages typical for this type of contract.
10. Termination
We may suspend or terminate your account if you materially breach these Terms, misuse the Service, or if we are required to do so by law or by an upstream provider. We will notify you in advance where feasible.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected.
If you are a merchant, legal entity under public law or special fund under public law, the exclusive place of jurisdiction for all disputes is Hannover, Germany.
12. Changes to these Terms
We may amend these Terms for good cause (e.g. changes in law, new features, security requirements). Registered users will be notified by email at least 30 days before a material change takes effect. Continued use after that date constitutes acceptance.
